Westerville Rapid Response (WRR) – Terms & Conditions

These Terms & Conditions (“Terms”) regulate all use of services provided by Westerville Rapid Response (WRR), a mobile automotive support, inspection, and assistance service. By booking, requesting, or receiving any service from WRR, you acknowledge and affirm that you have read, understood, and voluntarily agreed to be legally bound by these Terms, including all disclaimers, liability limitations, and waivers of legal claims.

These Terms apply to all customers, clients, vehicle owners, authorized users, website visitors, and service recipients (“Customer,” “You,” or “Client”).

1. Nature of WRR Services

WRR provides mobile automotive support, on-site vehicle assistance, and other related non-mechanical services. WRR staff travel to the specific location you provide at the time of booking and perform the service exactly as described in the booking request or service description. WRR does not function as a towing company, mechanical repair shop, emergency responder, medical service, or law enforcement entity. Our services are strictly non-emergency and do not involve full mechanical repairs.

WRR reserves the legal right to refuse or discontinue service at any location or under any circumstance if the requested service is unsafe, unreasonable, illegal, or outside the scope of what WRR is equipped or permitted to handle.

2. Binding Service Agreement

When you schedule a service through the WRR website, email, phone, text, or any other communication method, you enter into a binding agreement with WRR. By establishing an appointment, you confirm that you will be present when WRR arrives, that payment will be ready, and that the location and service details you provide are accurate. You also agree to all WRR policies, including—but not limited to—our Payment, Cancellation, No-Show, Denial, Safety, and Liability Waiver policies.

If you do not accept these Terms, you must not schedule or request WRR services. Continued use of our services constitutes acceptance of all policies described herein.

3. Eligibility to Use Services

To use WRR services, you must be at least 16 years of age and must either own the vehicle we are servicing or have clear permission from the legal owner. You must also have the full legal authority to authorize work on the vehicle, whether for yourself or another party. You must provide accurate personal information, an accurate service location, and truthful descriptions of the issue or service needed.

WRR reserves the right to verify your identity and ownership status. If you cannot provide documentation or proof when requested, WRR may decline service without penalty to WRR.

4. Appointment Requirements

By booking an appointment with WRR, you agree that the location you provide is accurate, accessible, and safe for our staff to work in. You agree that the vehicle will be present at that location upon our arrival and that you will answer calls or messages so we can properly assess the situation once on-site. You also agree to have payment ready immediately upon arrival before any service begins.

If any of these conditions are not met—such as the wrong address being provided, the vehicle being unavailable, the work environment being unsafe, or failure to respond—you will be charged the appropriate No-Show or Denial Fee.

5. Payment Terms

WRR requires full payment upon arrival, before any service begins. Payment must be made using cash, debit or credit card, or any digital payment method WRR officially lists as acceptable. If you are unable or unwilling to provide payment once WRR arrives, service will not be performed and the Denial Fee will apply.

If any service fees or penalties go unpaid, WRR reserves the right to pursue payment through invoicing, third-party collection agencies, or legal action. You are responsible for all collection-related charges, including administrative fees, processing fees, and any legal or attorney fees WRR incurs while securing payment.

6. Cancellations, No-Shows, and Denials

6.1 Cancellations

Cancellations must be communicated at least 24 hours before the scheduled appointment time. If you cancel after this window—or fail to cancel at all—you agree to pay a $25 late cancellation fee to compensate for the reserved time slot and preparation work completed by WRR.

6.2 No-Shows

A no-show occurs when WRR arrives at the scheduled location, but you are not present, do not answer communication attempts, the vehicle is missing, or the provided location is incorrect. If this occurs, you understand and agree that you will be charged a $40 no-show fee to cover the time, travel, and operational costs incurred by WRR.

6.3 Denial of Service

If WRR arrives and you refuse service, are unable to pay, or the environment is deemed unsafe or unworkable by WRR staff, you will be charged a $40 denial fee. This fee covers WRR’s travel time, fuel usage, and the appointment time slot.

7. Service Scope & Limitations

WRR provides only the services specified on our platform and will only perform tasks that fall within our listed capabilities. WRR does not perform mechanical repairs and will not attempt tasks that require specialized mechanical tools, advanced diagnostics, or activities deemed unsafe. If the vehicle is leaking fluids, smoking, unstable, or presents any danger, WRR may refuse or stop service immediately.

WRR is not responsible for pre-existing damage, hidden mechanical issues, worn-out components, or any consequential failure that arises after a standard service procedure is completed. WRR also assumes no liability for items lost inside the vehicle or damages that occur due to unsafe surroundings or hazardous conditions outside our control.

8. Safety & Compliance

WRR reserves the right to delay, cancel, or modify service if unsafe or uncontrollable conditions arise. These include—but are not limited to—bad weather, poor lighting, dangerous neighborhoods, road hazards, police or emergency activity, traffic conditions, or operational delays. If WRR cancels your appointment due to safety concerns, you will not be charged any fee.

9. Customer Responsibilities

By using WRR services, you agree to provide accurate and honest information regarding your location, vehicle condition, and the service you require. You must remain available for communication and ensure that the service area is safe and free from hazards. You are responsible for keeping children, animals, and bystanders away from the work area. You must not request services that violate local, state, or federal laws, nor interfere with WRR’s ability to perform the service.

If any damage or complications arise due to your negligence or unsafe surroundings, WRR is not responsible for resulting losses.

10. Liability, Damages, and Waiver of Legal Claims

To the greatest extent permitted by Ohio law, you agree to the following legal protections for WRR:

10.1 Limitation of Liability

WRR’s liability is strictly limited to the amount you paid for the specific service performed. WRR is not responsible for direct or indirect damages, mechanical issues that arise after service, personal property loss, transportation problems, lost income, or any harm caused by pre-existing vehicle conditions or customer negligence.

10.2 Hold Harmless Agreement

You agree to hold WRR, its employees, owners, affiliates, and partners harmless from any claim, damage, lawsuit, injury, loss, or legal action arising out of or related to the service provided. This includes situations involving third-party property, environmental conditions, or unsafe circumstances outside WRR’s control.

10.3 Agreement Not to Sue

By hiring WRR, you voluntarily agree not to sue WRR for any reason connected to the service provided. This waiver includes—but is not limited to—claims involving negligence, property damage, delays, dissatisfaction, improper results, or unexpected vehicle outcomes. You acknowledge that you are giving up your right to file a civil lawsuit against WRR except in circumstances prohibited by law.

10.4 Customer Assumption of Risk

You acknowledge that any form of vehicle assistance—such as unlocking, jump-starting, inspections, tire checks, or other roadside-style support—carries risks. By receiving WRR services, you voluntarily assume all risk associated with those procedures and accept responsibility for any outcomes.

11. Vehicle Ownership Confirmation

By requesting service, you confirm that you either own the vehicle in question or have the full legal authority to authorize work on behalf of the owner. You assume full responsibility for any disputes, challenges, or claims made by a third party asserting unauthorized service approval.

12. Refusal of Service

WRR reserves the right to refuse or discontinue service at any time if the Customer behaves aggressively, appears intoxicated, exhibits fraudulent behavior, fails to provide payment, requests illegal actions, or if the vehicle or location presents a safety risk.

13. Service Area

WRR operates within designated service zones. WRR may decline appointments outside its service area or may require additional travel fees if agreed upon beforehand.

14. Disputes & Governing Law

Any disputes arising from WRR services will be governed exclusively by the laws of the State of Ohio. You agree that all claims or disagreements—including those related to fees, service outcomes, or liability—must be resolved through binding arbitration rather than traditional court proceedings. You also waive your right to a jury trial. If WRR prevails in any dispute, you agree to pay all legal fees, arbitration costs, and related expenses.

15. Modification of Terms

WRR reserves the right to revise, update, or modify these Terms at any time without prior notice. Your continued use of WRR services after any modifications constitutes acceptance of the updated Terms.

16. Complete Agreement

By booking WRR services, you confirm that you have read these Terms fully, understand the legal protections granted to WRR, agree that all bookings are binding, and willingly accept all liability limitations, payment obligations, and waivers described above. You also agree that you will not pursue legal action of any kind against WRR and acknowledge that these Terms override any previous agreements or understandings.

These Terms form the complete and exclusive agreement between you and Westerville Rapid Response.
